1. Introduction

Dr Raoul Goldberg Inc is a patient-centered and integrative medical practice based on the holistic view of the human being as a living body, soul, and spirit. We work in the health sector and are healthcare professionals registered under the Health Professions Act of 1974, subject to the rules and regulations of the Health Professions Council of South Africa (HPCSA).

3. The Act

The Promotion of Access to Information Act (PAIA) grants a requester access to records of a private body where the record is required for the exercise or protection of a right. Requests must follow the prescribed procedures and rates set out in the Act. Requesters are referred to the Guide compiled under Section 10 by the South African Human Rights Commission (SAHRC), available at sahrc.org.za (Private Bag 2700, Houghton, 2041 · +27 11 877 3600).

4. Applicable legislation

Records legally required to be kept by the practice, and available on request, are held in terms of: the Companies Act, Employment Equity Act, Labour Relations Act, Basic Conditions of Employment Act, Unemployment Insurance Act, Protection of Personal Information Act, Occupational Health and Safety Act, and other legislation relevant to the business.

5. Schedule of records

All records may be requested in terms of PAIA. Access may be refused where required — records deemed confidential to a third party, for instance, require that party's permission before access is considered.

6. Form of request

To request a record: use the prescribed form, available from the SAHRC at sahrc.org.za; address the request to the Head of the Practice; and provide sufficient detail to identify the record requested, the requester (with proof of capacity if an agent is lodging the request), the form of access required, contact particulars, and the right being exercised or protected along with why the record is required for that purpose.

7. Prescribed fees

A requester is required to pay the prescribed request fee (R50.00) before a request is processed. If preparing the record takes more than the prescribed six hours, a deposit of up to one-third of the applicable access fee may be charged. A requester may apply to court against a request fee or deposit. Records may be withheld until fees are paid. The current fee structure is published by the SAHRC at sahrc.org.za.
